1. Acceptance
These Terms & Conditions (“Terms”) form a binding agreement between you and DigiChain (“DigiChain”, “we”, “us”) governing your access to and use of the DigiChain platform and services (the “Service”). By ticking the acceptance box, creating an account, or using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you accept on behalf of an organisation, you represent that you are authorised to bind it.
2. The Service
DigiChain lets approved institutions and employers issue tamper-evident credentials and employment records, anchors a cryptographic fingerprint (a Merkle root) of each batch to the Polygon blockchain, and lets anyone verify a credential's authenticity, integrity and revocation status. Individuals can claim credentials issued about them and share them selectively.
3. Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract.
- Issuing organisations are subject to a verification and approval step before they can issue on-chain. We may approve, decline or revoke issuer status at our discretion where warranted.
- You are responsible for the security of your credentials, API keys and signing access, and for all activity under your account.
4. Your responsibilities as an issuer (Data Fiduciary)
If you issue credentials or employment records about other people, you are the Data Fiduciary for that data under the DPDP Act, and you agree that:
- You have a lawful basis and any consent or notice required to upload and publish each individual's personal data.
- The data you issue is accurate, and you will correct or revoke it when it is not.
- You will not upload unlawful, defamatory, or excessive data. Employment records are limited to the structured fields we provide and must not include free-text conduct commentary.
- You will handle requests from your data principals (students, employees) as the law requires, and you instruct DigiChain to process the data solely to provide the Service.
5. Acceptable use
You agree not to:
- Issue false, fraudulent or misleading credentials;
- Upload personal data you are not entitled to process;
- Attempt to reverse, attack, overload or gain unauthorised access to the Service, other organisations' data, or the underlying blockchain;
- Use the Service to breach any law or third-party right.
We may suspend or terminate access for breach of these Terms.
6. Blockchain & immutability
You understand that anchoring writes only a non-personal Merkle root to a public blockchain, and that on-chain data is permanent and cannot be altered or deleted by us or anyone else. Verification depends on public blockchain networks and third-party infrastructure that we do not control and cannot guarantee to be continuously available. Revocation is supported and recorded, but it does not remove the original on-chain fingerprint.
7. Fees
Where fees apply to the Service, they will be communicated to you. Blockchain transactions may incur network (gas) costs. Except as required by law, fees are non-refundable.
8. Intellectual property
The Service, including its software, design and branding, is owned by DigiChain and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data you upload and grant us the rights needed to host, process and display it to provide the Service.
9. Disclaimers
The Service is provided on an “as is” and “as available” basis. DigiChain confirms whether a credential matches what an issuer anchored; it does not independently guarantee the truth of the underlying facts an issuer chose to certify. To the extent permitted by law, we disclaim all implied warranties.
10. Limitation of liability
To the maximum extent permitted by law, DigiChain will not be liable for indirect, incidental, special or consequential damages, or for loss arising from blockchain network behaviour, third-party services, or your own or another organisation's misuse of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify DigiChain against claims arising from your breach of these Terms, your unlawful processing of personal data, or the content you issue through the Service.
12. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate access for breach, legal reasons, or risk to the platform. On termination, the provisions that by their nature should survive (including sections 4, 6, 8–11 and 14) continue to apply.
13. Changes to these Terms
We may update these Terms. Material changes are versioned with a new effective date and, because your acceptance is specific to a version, we will ask your organisation to review and accept the updated Terms before continuing to use the Service.
14. Governing law & grievances
These Terms are governed by the laws of India, and the courts of India have jurisdiction, subject to applicable law. For any grievance, contact digichainpi@gmail.com. Data-protection complaints are handled as described in our Privacy Policy.
